Uh. Remember when I said that I'm in a real poor condition to handle any disappointments right now? Well, I was supposed to finalize the apartment deal this afternoon. Only that I didn't. The couple that was selling the flat freaked out because of a one detail in the agreement, which I had added to cover my ass (in the case where the tenant would refuse to leave), turned around and drove home. My offer is still binding and they accepting is still binding, too, but now we have to figure out a deal that we can both accept and sign.

I bust in tears when the broker called me. It was the broker's fault anyway, suggesting a deal that would get me screwed if the tenant would get difficult, and then I kicked the responsibility of the tenant to the sellers, who freaked. And then I had to call to the bank to say that the deal would be delayed and better luck next week.

And, at work my computer finally died and I had to use my initiative and take the new laptop already configured to me (but banned for me to use) to get the work done. Ok, said the Power that Be (via e-mail), but I would have to find some other work station from monday on, and I would get my actual computer sometime next month. This is just fine by me, since now I can't sit on the lobby. So what if the lobby will stand unguarded most of the time? Not my problem, because I can't sit there.

Yes, be cause that is sooo fun. Now I'm in a legal limbo: My offer was accepted but if there would be no deal, who would be to blame? When I first saw the flat, I was like, "what's the catch?" Well, this was it...

Did they say anything about the contract for the guy who rents the place? Is there a specific date when he has to move?

As of my knowledge, the tenant has until 30.9. to find a new place. The thing is that the flat could get free *before* that and they would want to sell it to me as soon as it's empty, never mind that *I* wouldn't have the time to note *my* landlady. Also, in the first contract it said that I would have to pay the flat 1.10 period. That would have meant that I would have to pay for it no matter if the tenant were still living there!

Now it looks like that the deal will be not conected to any certain day but it will be made when both the seller and the buyer have seen that the flat is empty. That wouldn't still solve the notifying-the-landlord-situation. I'm going to suggest either the there won't be an option for an earlier sale, or that they will drop the price for 500eur, which is a one moth rent.

Do you know how much the rent for the current tenant in the new apartment is? Because if they wouldn't leave from the apartment by the time you buy it, then they would be paying the rent to you. And if it was bigger than your current rent, you'd make a profit for the delay time... (Of course the notification times and the transition period can still get tricky, not to mention that you wouldn't be able to move.)

The rent the tennat is paying is 550, eur, 50 more than what I pay form mine, but then then are the 100eur yhtiövastike, and the 680eur for the loan, and I would have to pay taxes for that rent, so, not really a realistic option.

AFAIK, you can deduce interests from the taxable rent income, so there shouldn't be any tax to pay on the rent.

The major problem, nevertheless, is that whatever damages or other trouble the current tenant causes to the appartment, is then up to you.

Yep, if the tenant would blow the apartment apart before leaving, if would be my problen to fix it and then sue him or something, and that's just the situation I want to awoid here.

From hell. I forgot my phone at home so TR had to bring it to me. I had two meetings of doom and patient dropped dead in the middle of lunch. Not the best of days.

Bugger. But shouldn't selling the apartment be reason enough to evict the current tenant (at the end of their lease), if necessary?

As of my knowledge, the tenant has until 30.9. to find a new place. I presumed that he had just lived there so long that he was entitled for such a long time, but dunno. It might as well be that he isn't even officially noted yet. He is supposed to move to Lahti to study or something. the other thing is that the sellers want me to pay for the flat as soon as it's empty, never mind that then I couldn't notice *my* land lady from my move early enough to not pay for an extra month. Let's see what happens. The sellers refused my clause to get notified 33 days earlier, so I don't know how it's going to be in the sales contract.

That's weird. I suggest you find out asap if the current tenant has been given a notice, to make sure that won't be a problem (I don't remember what the official notice times are, but if I remember correctly, it might be up to half a year if they've lived in the flat long enough).

Anyway, I would think you should be able to know the exact date the apartment will be empty way more than 33 days in advance. So I don't know what the seller is worried about (but then, I'm no expert in these matters, so I'm no help to you, I'm afraid). Hope it all works out for you!

Yes, the rules of eviction are challenging enough that I wouldn't want to cope with a truly troublesome tenant - and don't take the seller's word for the current tenant's intentions.

Anyway, I think E has always been under the impression that the current owner is responsible that the appartment is free (and in current condition) on the specified date. Typically deals include a few clauses to cover for such cases: Firstly, in case of delay the seller will pay the buyer any reasonable costs caused by the delay. I've even heard of cases where a two-month stay in a hotel were paid for. Secondly, if the current tenant destroys the property before leaving, the seller must either mend the damages at his own cost. A camera and a few reels of film are very valuable tools in documenting the condition of the appartment at the time of signing the contract.

Doh, sorry to hear that. Hopefully they come to their senses, as in, it's fair to know in advance when you can move in and start paying from that.

My day, trying to get things done for the zerg invasion ^^^DD party on Sunday. Note: When inviting kids over, COUNT them properly before sending out invitations. 'A few people from kindergarden' plus 'couple of friends' plus two resident ones added up to nearly twenty kids. At least some aren't coming, phew.

Whoo, I have been in my sister's kid' parties, and they are a mayhem. I was like, "why make a cake? Why make out program? The only thing that kids do anyway is eat all the candy and then run around like mad in their sugar rush."
